510 08/31/2015 FINAL AMENDED JUDGMENT AND ORDER OF DISMISSAL WITH PREJUDICE amending [500] Judgment: Plaintiffs' unopposed motion to amend the Judgment to include four additional Persons who timely sought exclusion from the Class as part of this Judgment is granted and said Persons are now included in Exhibit 1 attached hereto. Accordingly, the Court authorizes and directs implementation and performance of all the terms and provisions of the Stipulation, as well as the terms and provisions hereof. Except as to any individual claim of those Persons (identified in Exhibit 1 attached hereto) who have validly and timely requested exclusion from the Class, the Court hereby dismisses the Litigation and all Released Claims of the Class with prejudice. The Settling Parties are to bear their own costs, except as and to the extent provided in the Stipulation and herein. Upon the Effective Date, and as provided in the Stipulation, Lead Plaintiff and the Class Representative shall, and each of the Class Members shall be deemed to have, and by operation of this Judgment shall have, fully, finally, and forever released, relinquished, and discharged any and all Released Claims (including Unknown Claims) against the Released Persons, whether or not such Class Member executes and delivers the Proof of Claim and Release form or shares in the Settlement Fund. Claims to enforce the terms of the Stipulation are not released. Lead Plaintiff, Class Representative and all Class Members are hereby forever barred and enjoined from prosecuting any of the Released Claims against any of the Released Persons, and as further set forth in this order. 501 07/30/2015 ORDER APPROVING PLAN OF ALLOCATION OF SETTLEMENT PROCEEDS: IT IS HEREBY ORDERED, ADJUDGED, AND DECREED that: This Order incorporates by reference the definitions in the Stipulation of Settlement dated as of February 8, 2015 (the "Stipulation") and all capitalized terms used, but not defined herein, shall have the same meanings as set forth in the Stipulation. This Court has jurisdiction over the subject matter of the Litigation and over all parties to the Litigation, including all Members of the Class. Pursuant to and in full compliance with Rule 23 of the Federal Rules of Civil Procedure, this Court hereby finds and concludes that due and adequate notice was directed to all persons who are Class Members who could be identified with reasonable effort, advising them of the Plan of Allocation and of their right to object thereto, and a full and fair opportunity was accorded to all persons and entities who are Class Members to be heard with respect to the Plan of Allocation. And as set forth herein. I held oral argument on this issue on March 8, 2013. For the reasons stated on the record, I find that documents held by Tim Hendley, a KPMG forensic audit partner who worked with Defendants, may be relevant to the case, and I deny KPMG's motion that seeks to block Plaintiff from accessing those records. KPMG, however, is entitled to reimbursement for some its costs in responding to Plaintiff's subpoena. The parties have agreed that Plaintiff will pay KPMG $65,000 in settlement of the $123,051.56 of costs so far incurred. I rule as follows:Depositions of trial witnesses: Plaintiff seeks to depose all 19 witnesses that Defendants indicated that they could potentially call at trial. Defendants respond that they ""ill only call 10 or fewer of these 19 witnesses. Defendants must provide a list of witnesses they plan to call at trial by March 15, 2013. Plaintiffs may depose the witnesses on that list only.Depositions of witnesses with knowledge of Bextra, Geodon, Zyvox, and Lyrica: Plaintiff has identified 17 witnesses who potentially have information on the off-label use of these tour drugs. Plaintiff is entitled to eight to ten depositions of these witnesses; the parties shall exchange information to determine who of the 17 witnesses should be deposed. Depositions of Defendants' internal auditors: Plaintiff seeks to depose individuals at Pfizer who conducted internal audits. The parties have identified two individuals who were in charge of the internal audits; Plaintiff may depose those individuals.If Plaintiff seeks any depositions beyond those allowed under this order, Plaintiff must show, by a "2En letter, why the proposed deponent would provide relevant information that had not previously been uncovered through discovery. See Indiv. R. 2E. Documents from Dennis Block: Plaintiff seeks documents from Dennis Block, who served as outside counsel to Pfizer. Block is relevant to the case in that the Defendants may have acted in good faith in relying on his advice. Plaintiffs may obtain documents from Block, but only to the extent that those documents relate to information and advice that Block gave to Defendants. 37 11/04/2010 SUMMARY ORDER APPOINTING LEAD PLAINTIFF: For the reasons stated on the record, I grant Philips Pensioenfonds' motion for appointment as lead plaintiff and deny Oklahoma Firefighters and Union's competing motion. Moreover, I approve Philips Pensioenfonds' selection of Robbins Geller Rudman & Dowd LLP as lead counsel for the proposed plaintiff class. Although I deny Oklahoma Firefighters and Union's motion for approval of their chosen counsel as co-lead counsel for the class, I suggest that Robbins Geller Rudman & Dowd LLP consider incorporating into their litigating group the attorneys who represent Oklahoma Firefighters and Union, to the extent that such cooperation would enhance the efficiency of this litigation without duplicating efforts or causing undue expense. Philips Pensioenfonds should submit a stipulation and proposed order for the court's approval by November 12, 2010, setting forth a deadline for plaintiffs to amend their complaint and for defendants to answer or otherwise respond.
